01These terms
These terms are the agreement between you and Marv for the website at meetmarv.org and the Marv app for Windows. “We”, “us” and “Marv” mean the people who publish that website and app. “You” means the person using them.
By joining the waitlist, creating an account, installing the app, or keeping on using either service, you agree to these terms and to the Privacy Policy. If you do not agree, do not join the list and do not use the app.
If you use Marv for a business, you confirm that you have authority to bind that business. You are responsible for anyone who uses Marv on a computer or account you control.
Nothing in these terms removes a right that the law of England and Wales, or another law that applies to you and cannot be waived, says you must keep. That includes rights under the Consumer Rights Act 2015 where you are a consumer.
02The services
Marv is a Windows companion. The website introduces Marv and takes early-access signups. The app sits on your desktop, listens while you hold its talk hotkey, can look at the screen when you ask it to, answers out loud, and can draw circles, arrows and highlights to show a next step.
The pictures on the website are illustrations. The privacy switch, the keycaps and the Notepad window on the homepage do not turn on your microphone and do not capture your screen.
Marv is in early access. Features can be incomplete, can change, and can be withdrawn. A place on the waitlist is not a promise of a release date, a particular feature, or a free or paid plan.
The app is for Windows. We do not promise that it will work on every Windows version, on every display setup, or with every other program you have installed.
03The waitlist
If you submit the form on the website, you ask us to save your email address, the date you joined, and any note you choose to leave. The first time that address joins, we send one confirmation email. Sending the same address again, including to leave a note, does not send another confirmation and does not reset the original join date.
We use the list to run early access and to reply to a note. A signup is not an account in the app, and it does not by itself create a licence to a finished product.
You can ask us to take your address off the list. Use Contact on the homepage and leave a note from the same email address, or email hello@meetmarv.org.
04Accounts
Some parts of the app need an account. You give an email address and a password, and you confirm the email when we ask you to. You can also give a display name.
You must give information that is true, keep your password to yourself, and tell us if you think someone else is using your account. We may refuse a signup, close an account, or sign you out if we reasonably believe the account is being misused, the email cannot be confirmed, or we have to do so to protect the service or other people.
You are responsible for activity on your account until you tell us it is no longer in your control and we have had a reasonable chance to act.
05Your computer
The app runs on your PC. To do what you ask, it needs permission to use the microphone and, when you ask it to look, to capture what is on the screen. Those captures are made for the request you started. They are not a background recording of your day.
You stay in control of that access. Holding the talk hotkey is the instruction to listen. Pause turns the microphone and screen capture off. You can refuse Windows permissions, and the related feature will not work until you allow it.
Before a capture is sent, the app paints over windows that match its denylist, including password managers, banking-like titles, private browser windows, and titles you add. That reduces what leaves the computer. It is not a guarantee that every sensitive window will be recognised. Do not ask Marv to look at a screen you are not willing to send for that request.
The app can draft files under Documents/MARV on your computer. It does not send, delete, or pay on your behalf unless you confirm that action on screen. You are responsible for reading a draft before you use it, send it, or rely on it.
You are responsible for the computer you install Marv on, for keeping Windows and the app reasonably up to date, and for your own backups. Marv is not a security product and does not replace one.
06Your instructions
You keep the rights in the words you speak or type, the files already on your computer, and the work you create with them. You give us, and the providers who process a request for us, permission to use that material only as needed to run the feature you asked for, to keep the service secure, and to fix a fault you report.
You confirm that you have the right to show Marv the screen, the audio, and the files you ask it to use. Do not point Marv at someone else’s private information, a workplace system, or a confidential document unless you are allowed to.
We do not claim ownership of your files or of the text of your conversations. Guide drawings are painted for that moment. They are not a separate work we keep.
07Acceptable use
Use Marv lawfully, and only on computers and accounts you are allowed to use. You must not:
- break into, probe, or overload the website, the app, or the account service, or try to get past a limit, a permission, or an access control;
- use Marv to record or inspect another person without a proper right to do so;
- ask Marv to create or carry out anything illegal, or to hide that you are doing so;
- interfere with anyone else’s account, waitlist signup, or device;
- resell, sublicense, or offer the app as your own service, or copy the product except as these terms or the law allow;
- remove credits, licences, or notices that travel with the app, the fonts, or the artwork;
- use the service to send spam, or to sign other people up without their say-so.
We may suspend access if we reasonably believe you have broken this section. Where we can do it safely, we will tell you why and give you a chance to put it right.
08Answers from Marv
Marv’s replies are generated. They can be wrong, incomplete, or out of date. A highlight on the screen can point at the wrong control. A spoken answer is not professional advice.
Do not rely on Marv for a decision that needs a qualified person, including a medical, legal, financial, employment, or safety decision. Check anything important yourself before you act on it, especially before you change a file, send a message, move money, or change a setting you cannot easily undo.
To answer you, the app sends the request to a model provider. Which provider is used depends on how the app is configured. Those providers process the request under their own terms as well as ours. The Privacy Policy explains what is sent.
09Plans
Early access may be free. If we offer a paid plan, we will show the price, the billing period, and what is included before you pay. Taxes may be added where the law requires them.
Payments are taken by a payment provider. We do not ask the app to store your full card number. If a payment fails, the paid part of the service can stop until it succeeds.
Where you are a consumer in the United Kingdom, you may have a statutory right to cancel a paid plan in the cooling-off period. We will tell you, at the point of purchase, if starting the digital service immediately affects that right. A free waitlist signup is not a purchase.
Unless a paid plan says otherwise, fees already due are payable. We do not promise refunds beyond the rights you already have in law.
10Intellectual property
We own Marv, the Marv name, the wordmarks, the character, the website design, and the software, except for pieces used under a separate licence. The fonts on the website are used under the SIL Open Font Licence. Those licences stay with those pieces.
We give you a personal, revocable, non-exclusive licence to install and use the app on computers you control, and to use the website, for as long as these terms apply. The licence is for ordinary use of the product. It is not a sale of the software.
You may not copy the character or the brand for your own product, and you may not reverse engineer the app except where a law that cannot be waived lets you do so.
11Privacy
The Privacy Policy explains what information the website and the app handle, why, and the choices you have. It is part of how we describe the service. It is not a second set of commercial terms.
12Changes and availability
We may change the website, the app, or these terms. If a change to these terms is material, we will post the new terms on this page and change the date at the top. If you have an account, we will also use the email on that account when the change affects how you pay or what happens to your content. The new terms apply from the date we state. If you do not agree, stop using Marv and, if you have an account, ask us to close it.
We try to keep the website and the app available, but we do not promise uninterrupted access. Maintenance, a fault, a provider outage, or a limit on email or sign-in can take a feature offline. Early access can pause.
13Stopping
You can stop using the website at any time. You can uninstall the app. You can ask us to close an account and to remove a waitlist signup.
We can stop providing the service, or stop providing it to you, if we discontinue Marv, if we have to for legal reasons, or if you materially break these terms. Where the reason is a break we can remedy by notice, we will tell you and give you a reasonable chance to fix it, unless doing that would put someone else at risk.
When these terms end, the licence to use the app ends. Sections that by their nature should continue still apply, including intellectual property, acceptable use as it relates to misuse that already happened, responsibility, and the governing law.
Uninstalling the app does not by itself delete every file Marv has written, including drafts under Documents/MARV, or every setting stored for the app on that PC. The Privacy Policy explains the delete control inside the app.
14Responsibility
Marv is provided with reasonable care and skill. We do not promise that it will be error free, that every answer will be correct, or that it will suit a purpose you have not told us about and we have not agreed.
We are not liable for loss that was not a reasonably foreseeable result of our breaking these terms, for loss you could have avoided by taking reasonable care, or for things you do with an answer or a draft after we have given it to you. We are not liable for a provider, network, or operating system outside our reasonable control.
If you are a consumer, we do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law says we cannot exclude. Subject to that, if we are liable to you for a chargeable plan, our total liability in a year is limited to the amount you paid us for that plan in that year. If you use only the free waitlist or a free early-access build, and you are not a consumer, our total liability to you for all claims in a year is limited to £100.
If you use Marv in a business, then except for liability we cannot exclude, we are not liable for lost profit, lost data, business interruption, or indirect or consequential loss. You should keep your own copies of files that matter.
15Law and contact
These terms are governed by the law of England and Wales. The courts of England and Wales hear disputes about them. If you are a consumer living in another part of the United Kingdom, you can also use the courts of the country you live in. Nothing in this section removes a mandatory protection in the country where you live.
If a court finds that one part of these terms is not enforceable, the rest still applies.
